Terms of Service

1. Commission Scope & Acceptance

By placing a commission with UnStaybleArts (Anthony), you agree to these terms. Each commission is a custom artistic work created according to your specifications and my artistic judgment.

I reserve the right to decline any commission that conflicts with my values or artistic boundaries. All commissions are non-refundable once work has begun, though partial refunds may be offered if significant work hasn't started.

2. Payment Terms

Payment is typically split 50/50: 50% non-refundable deposit upfront, 50% upon completion. For smaller commissions, full upfront payment may be requested. Payment accepted via:

  • PayPal
  • Stripe / Credit Card
  • Direct transfer (contact for details)

If payment is not received within 14 days of the invoice, the commission slot may be released and offered to another client.

3. Turnaround Times

Turnaround estimates are provided upfront but are not guaranteed. Timelines depend on:

  • Current workload and queue
  • Complexity of the commission
  • Number of revisions requested
  • Circumstances beyond my control (illness, emergencies)

Rush orders are available for an additional fee. Extensions may be granted if circumstances require; I will communicate any delays as soon as possible.

4. Revisions & Corrections

Unlimited revisions are included until the final artwork meets your satisfaction. Revisions should be clearly communicated and reasonable in scope. Major redesigns or scope changes may require renegotiation of the commission fee.

5. Usage Rights & Licensing

Personal Use (Default)

Unless otherwise specified, all commissions are created for personal, non-commercial use. You may use the artwork for:

  • Personal enjoyment and display
  • Social media sharing (with proper credit to UnStaybleArts)
  • Portfolio or personal website
  • Personal printing (t-shirts, posters, etc. for yourself only)

Commercial Use

For commercial use—selling products, using in a game, monetizing on YouTube, or any profit-generating application—you must purchase the "Commercial-Use License" add-on. This grants you the right to use the artwork commercially, though I retain all original IP rights unless otherwise negotiated.

Original Characters & IP

I retain all rights to my original characters, game IP, and design concepts. A commission buys you a custom illustration or design service, not ownership of the underlying original IP.

You may create fan-art commissions of your own characters or existing media (anime, games, etc.), but you do not own the rights to fan-art artwork of copyrighted characters. Those rights remain with the copyright holder.

6. Credit & Attribution

While not required, I appreciate credit to UnStaybleArts or a link to my portfolio when you share your commission. You are never required to share your artwork publicly, but if you do, attribution is appreciated.

7. Refund Policy

  • Before work begins: Full refund of the deposit minus any non-refundable fees (typically 10%).
  • Work in progress: Partial refund based on the percentage of work completed (75% complete = 25% refund, etc.).
  • Upon delivery: No refunds. The artwork is yours to keep and use according to these terms.

Refund requests must be made in writing within 3 days of the commission agreement. Refund processing takes 5–7 business days.

8. Acceptable Use & Content

I will not create artwork that:

  • Promotes hatred, violence, or discrimination
  • Contains explicit sexual or pornographic content
  • Infringes on third-party intellectual property rights (unless it's fan-art you've commissioned)
  • Is used for illegal purposes

If a commission violates these guidelines, I reserve the right to decline or cancel without providing a refund.

9. Intellectual Property

My Work: I retain the right to use your commission as portfolio/promotional material, including posting on social media, my website, or in portfolios (unless you request otherwise in writing). I will always credit you when possible.

Your Input: Any references, descriptions, or ideas you provide may be incorporated into the artwork. By providing them, you grant me the right to use them in the creation of your commission.

10. Disputes & Communication

If you're unsatisfied with your commission, please reach out immediately. I aim to resolve any issues through conversation and revision. Disputes should be resolved between us privately before any public action is taken.

I reserve the right to stop communication with clients who are abusive, disrespectful, or unreasonable in their demands.

11. Limitation of Liability

UnStaybleArts is provided on an "as-is" basis. I am not liable for any indirect, incidental, or consequential damages resulting from your commission or use of the artwork. My total liability is limited to the amount paid for the commission.

12. Changes to These Terms

These terms may be updated at any time. Changes will be posted here with an updated date. Existing commissions are not affected by changes to these terms; new commissions will be subject to the current terms.

13. Governing Law

These terms are governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation and, if necessary, arbitration or legal proceedings.
